# Workplace Safety and Health Council is established by Workplace Safety and Health Act 2006

The WSH Council's statutory basis is Part 8 of the Act; section 40A sets out its functions and section 40B provides for issuing or approving codes of practice. This does not transfer MOM OSH Inspectorate enforcement powers to the Council.
